Terms and Conditions

I, blackpulse (hereinafter referred to as “I”, “me”, “my shop”, or “we”) operates this online store at https://shop.blackpulse.studio.

I am an individual seller (not a registered company) based in France offering niche products to customers, primarily in the European Union. These Terms and Conditions govern all purchases made through the Shop.

By placing an order, you agree to these Terms and Conditions. Please read them carefully before ordering.

1. Products and Orders

  • All products displayed on the Website are offered subject to availability.
  • Descriptions and images are provided for information only and may slightly differ from the actual product.
  • Prices are in Euros (€), inclusive of French VAT (if applicable) but exclusive of shipping costs unless stated otherwise.
  • I reserve the right to modify prices and product availability at any time. The price in force is the one displayed at the time of order validation.
  • Orders are confirmed upon receipt of full payment.

2. Payment

  • Payments are processed securely via WooCommerce official payment methods. I do not store your full payment details.
  • Accepted payment methods: bank transfer.
  • Full payment is required at the time of order. No order will be processed without payment.

3. Shipping and Delivery

  • Shipping is available worldwide.
  • Delivery times are indicative: 3 business days in France, 4 to 5 business days within the EU, and 7 days to several weeks outside outside the EU. Delays may occur due to carriers or force majeure.
  • Shipping costs are calculated at checkout and depend on destination, weight, and carrier.
  • Risk of loss or damage passes to you upon delivery (or handover to the carrier).
  • For international orders, customs duties, taxes, or import fees are your responsibility.

4. Right of Withdrawal

As a consumer in the EU, you have the right to withdraw from the contract within 14 days without giving any reason.

  • The withdrawal period expires 14 days after the day you (or a third party designated by you, not the carrier) receive the goods.
  • Products must be returned in perfect condition, unused, and in their original packaging.
  • You must return the goods at your own cost and risk.
  • To exercise this right, inform me of your decision by email at studio.blackpulse@gmail.com.
  • The return address will be provided in response to your withdrawal email.
  • Refunds will be issued within 14 days of receiving the returned goods (or proof of return shipment), using the same payment method.
  • You are liable for any diminished value due to handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
  • No refund will be issued if the item is damaged or marked (e.g., creased, written on).

Exceptions:

  • No right of withdrawal for personalized items.
  • No right of withdrawal for sealed goods unsealed after delivery (hygiene/health reasons).
  • No right of withdrawal for digital content (if started with your consent).
  • No right of withdrawal for products not returned in perfect condition and unused.
  • No right of withdrawal for products not returned in their original packaging.

5. Returns and Refunds

  • In addition to the 14-day withdrawal, defective or non-conforming goods must be reported within 14 days of receipt.
  • Return shipping is at your expense unless the product is faulty (in which case I reimburse reasonable return costs).
  • Refunds for faulty items include the product price and original shipping costs.

6. Liability and Warranties

  • I am liable only for direct damages caused by my fault, up to the order value.
  • Products benefit from the legal conformity guarantee (2 years in France/EU) and hidden defects guarantee.
  • I am not liable for indirect damages, loss of profit, or issues due to misuse.

7. Intellectual Property

All content on the Website (photos, texts, designs) is my property or licensed. Unauthorized use is prohibited.

8. Force Majeure

Neither party is liable for delays or failure due to events beyond control (e.g., strikes, natural disasters, pandemics).

9. Governing Law and Disputes

These Terms and Conditions are governed by French law. In the event of a dispute, we strongly encourage amicable resolution first, please contact me directly at studio.blackpulse@gmail.com so we can find a solution together.

As a consumer in the European Union, you may also use the European Online Dispute Resolution (ODR) platform to submit a complaint: https://ec.europa.eu/consumers/odr/

At this time, I have not yet adhered to a specific consumer mediation service. However, in accordance with French law, you have the right to recourse to a mediator of consumption for the amicable resolution of any dispute. You can find a list of approved mediators on the website of the Commission d’Évaluation et de Contrôle de la Médiation de la Consommation (CECMC): https://www.economie.gouv.fr/mediation-conso/liste-des-mediateurs-references

Otherwise, for any unresolved dispute, the competent courts shall be those of Montauban (Tribunal judiciaire de Montauban), or the courts of your place of residence if you are a consumer.

10. Changes to Terms

I may update these Terms. Changes will be posted here with a new “Last updated” date. Continued use after changes constitutes acceptance.
